Legal basis for medicine price regulation
The Price Ordinance 1961, no 117 gives the Minister of Economic Development legal basis to establish the maximum prices for medicines since 2012. However, this ministerial Regulation was revised in 2019 applying necessary adaptations in the previous ordenance; mainly involving the allowable markup percentage for generic and brand- name drugs. It is important to note that these price regulations for medicines only applies to registered medicines categorized as prescription only (UR) and pharmacy only (UA).
Review Maximum Prices
The 2019 amendment sets the review of maximum prices for medicines at least quarterly. These established maximum prices are mainly intended for the importers of medicine, although it also serves as the basis for the maximum retail prices in pharmacies. Pharmacies can then add a surcharge to these prices or charge a separate prescription fee in certain cases.
