A ‘Standplaats’ or ‘vent’?

In accordance with the National Ordinance on Public Order, it is prohibited to take up a stand on a public road offering goods for sale or offering services without a permit granted by the ministry of Economic Development.

The underlying considerations for this law, are focused to guarantee public order by:

  1. Preventing physical damages to public roads;
  2. Preventing and limiting damage to the interests of third parties and inconvenience to users of nearby real estate;
  3.  Ensuring the efficient and safe use of public roads to prevent road safety from being endangered;
  4. Not hinder the effective management and maintenance of the road and/or hinder or prevent damage to the usability of the road;
  5. Prevent nuisance or pollution on site due to the location and do not damage the quality of the public road;
  6. Guaranteeing the continued accessibility of public roads.

People who wish to sell goods or services on a public road, can apply for either a ‘standplaats’ permit or a ‘vent’ permit. Here’ s the difference;

‘Standplaats’ Permit

The ‘standplaats’ permit is for those who wish to be located in a specific place on public roads to offer their products or services. Be it permanent (every day) or temporary (only for a specific event or period).

The ‘Standplaats’ permit consists of 5 categories:

  1. Non-food location: a location for the sale of items using a stall or a vehicle. For example, a souvenir stand;
  2. Food stand: a place for the sale or offering of prepared or unprepared food or drink to the public. Examples include mobile canteens, a stall, an ice cream cart or a hot dog cart;
  3. Artist stand with or without a stall;
  4. Information kiosk; location intended for providing information;
  5. Seasonal locations; intended for only seasonal sales such as Christmas trees, fireworks or if an event permit has been granted

Having a ‘standplaats’ permit means that the kiosk or stand has to be removed daily from the Public Roads and reinstalled at the operation hours indicated on the permit.

‘vent’ permit

Do you want to sell products/services on the street or door-to-door? And you do not have a permanent location? Then you need a ‘vent’ permit.

This means that with a ‘vent’ permit you’ll always stay mobile, offering your products/services and that you only remain in a certain location long enough to serve a customer.

As a holder of a ‘vent’ permit, you can sell your products/ services in the following ways:

  • on foot;
  • from a vehicle (station wagon, van, pick-up, scooter, etc.);
  • on a cart (e.g. hotdogs, ice-cream etc.)

 

People can also acquire a temporary ‘vent’ permit to sell products during a specific event or season. For example on Kings’ Day, during Carnival or ‘Seú’ Parades etc.
